Information on the exercise of the right of withdrawal

The consumer can withdraw from a contract concluded outside the business premises of the operator in accordance with § 11 Fern- und Auswärtsgeschäfte-Gesetz (FAGG) or § 3 Consumer Protection Act (KSchG). As a consumer, you therefore have the right to revoke the contract you have concluded with Kofferbutler GmbH as an entrepreneur within fourteen days without giving any reasons. The right of withdrawal also applies to contracts between the entrepreneur and the consumer that are concluded without the simultaneous physical presence of the contract partners (distance selling).

The withdrawal period is fourteen days and starts with the signing of the contract in which the clarification about this right of withdrawal and the transmission of the corresponding documents also takes place, but not before the receipt of the corresponding order confirmation. With the handover of the luggage to the Kofferbutler GmbH as entrepreneur, the consumer expressly waives the right of withdrawal to which he is entitled.

You can use the attached model withdrawal form for this, but it is not mandatory. The declaration of withdrawal is not bound to any specific form.

It is sufficient to send the notification about the exercise of the right of withdrawal before the end of the withdrawal period to maintain the withdrawal period.

Consequences of Withdrawal:
Should there be a right of withdrawal, the entrepreneur's obligation to provide his services begins at the earliest with the expiry of the withdrawal period, unless you as a consumer expressly waive your right of withdrawal. You can expressly waive your right of withdrawal, but also by taking the initiative to exercise the services provided by the entrepreneur, which is particularly the case if you, of your own accord, arrange an appointment for the provision of Kofferbutler GmbH services. You waive your right of withdrawal, especially when you hand over your luggage to Kofferbutler GmbH for delivery. In case of doubt, a waiver of your right of withdrawal must be assumed.

If you revoke the contract, the entrepreneur must repay all payments she has received from you immediately and at the latest within fourteen days from the day on which the notification of your revocation of this contract reaches her. For this repayment, the entrepreneur uses the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged for this repayment.

If you as a consumer order goods outside the business premises of Kofferbutler GmbH or by mail order, the following applies: The withdrawal period is fourteen days and starts with the delivery of the goods. If you revoke the contract, you must return the received goods immediately and at the latest within 14 days from the submission of the declaration of withdrawal to the entrepreneur (timely dispatch is sufficient). For goods that cannot be returned normally by post due to their nature, the goods will be picked up. The return shipping costs are to be borne by you. You will have to replace a loss in value of the goods if the loss in value is due to a handling that is not necessary to test the nature, characteristics and functionality of the goods.is due to agile handling. The entrepreneur is not obliged to refund your payments until she has not received the goods back or you have provided her with proof of the return.
